Terms and Conditions

Art. 1 – General provisions

These General Terms and Conditions of Sale (hereinafter the “Terms of Sale”) apply to all commercial relationships between Corpore Sano S.r.l., with registered office in Naples, Via Piazza dei Martiri, 30, VAT no. 09017141210 (“Corpore Sano”), and any person, sports centre, gym, medical practice, etc. (“the Customer”), and shall apply regardless of any conflicting, additional or contrary terms of sale contained in any purchase order or other written communication originating from the Customer and addressed to Corpore Sano.
These Terms of Sale apply to the sale of products and/or services made by Corpore Sano through the App, in accordance with the provisions of Part II, Title III, Chapter I, of the Italian Consumer Code (Legislative Decree no. 206/05, as amended by Legislative Decree no. 21/14 and Legislative Decree no. 70/03).
Before proceeding to purchase the products/services supplied by Corpore Sano, the Customer is required to read these Terms of Sale, which are deemed to be generally and unequivocally accepted at the time of purchase.
The Customer is invited to download and print a copy of the purchase form and of these Terms of Sale, the terms of which Corpore Sano reserves the right to amend unilaterally and without any prior notice.

Art. 2 – Subject matter

These Terms of Sale govern the offer, submission and acceptance of purchase orders placed through the Eathlon Application (hereinafter the “App”) and, in particular, the supply of specific meal plans through the digitalisation of the nutritionist’s activity, which enables the automatic generation of such plans in a personalised manner for the customer who registers on the App. They do not, however, govern the supply of services or the sale of products by parties other than the seller that are present on the same site through links, banners or other hyperlinks.
The Meal Plan called Eathlon, developed on a scientific theory validated by international experts, must not be regarded as an alternative to nutritional therapies prescribed by medical specialists, nor as a specific therapy for particular pathologies, but consists of a dietary regimen based on the Mediterranean Diet that is suitable for amateur and semi-professional athletes, as well as for people who wish to improve their psychophysical well-being.

Art. 3 – Conclusion of the contract

To conclude the contract for the purchase of the Meal Plan, it is necessary to download the Eathlon App, accept the Terms and Conditions and the Privacy Policy, register by entering an email address and password or through social login, and complete the onboarding phase by entering the data required to profile the user.
The user is entitled to a 7-day free trial.
At the end of the free trial, the user may decide which subscription to purchase, choosing from among the subscriptions offered in the app.
The contract is concluded when Corpore Sano receives the form completed by the Customer, following verification of the data contained therein.
The Customer shall be obliged to pay the price from the moment the online order submission procedure is completed. This will occur by clicking on the button of the chosen subscription.
Once the contract has been concluded, Corpore Sano takes charge of the order for fulfilment.
The user is informed and acknowledges that the Eathlon services are offered in the form of digital services and content, and that performance of the contract begins at the moment of payment for the meal plan.
For users coming from affiliated partners and partners of Corpore Sano S.r.l., reference is made to the specific terms of use of the service agreed between Corpore Sano S.r.l. and the Partner.

Art. 4 – Registered users

In completing the registration procedures, the Customer undertakes to follow the instructions provided in the App and to provide their personal data correctly and truthfully.
Confirmation shall in any case release Corpore Sano from any liability regarding the data provided by the Customer. The Customer undertakes to promptly inform Corpore Sano of any change in their data and in the parameters communicated at any time.
Should the Customer provide inaccurate and/or incomplete data or incompatible parameters, Corpore Sano shall have the right not to activate, or to suspend, the supply of the Meal Plan until the relevant deficiencies have been remedied.
In the event of use, the User warrants and declares the following:
– that they are in good health and in a physical condition suitable for our meal plans;
– that the information provided through the online medical history questionnaire is truthful and accurate;
– that they do not suffer from oncological, cardiac or joint conditions, nor from hypertension, obesity, high cholesterol or diabetes, nor have a family history of such conditions;
– that they have not received any contrary opinion from their own doctor regarding one or more dietary regimens in relation to their state of health;
– that they have no reason to believe, for any reason, that they should not follow the Eathlon meal plans.
On the occasion of a Customer’s first activation request, the Customer will be asked to assign themselves an email address and a password, which will constitute the system for validating the Customer’s access to the services and the only system suitable for identifying the Customer; acts carried out through such access will be attributed to the Customer and shall be binding upon them.
The Customer undertakes to keep their access credentials confidential, to store them with due care and diligence, and not to disclose them to third parties, even temporarily.

Art. 5 – Services offered

The services offered by Corpore Sano consist of the provision, to the customer who requests it, of a personalised Meal Plan, based on the sport practised, the physical characteristics and the goal of the user, using an innovative methodology that differs from all others present on the digital market in the type of diet offered. EATHLON™ is the only method that uses different cooking techniques and food combinations so that food performs its function as natural fuel for those who play sport, giving importance to the physiology and biochemistry of foods.
Eathlon offers meal plans that are in no case to be considered medical advice or a medical diagnosis.
The offer is detailed on the Store pages of our Eathlon App, which can be downloaded from the App Store or Google Play Store.

Art. 6 – Payment methods

The price of the Meal Plans is the one indicated in the relevant Subscriptions section of the Eathlon App.
The prices indicated in the App include VAT.
Once the type of subscription has been selected, its cost will be charged directly to the customer’s iTunes or Google Play Account at the end of the free trial period, where applicable.
Should the customer not wish to be charged the cost of the chosen subscription at the time of registration, it will be sufficient to access the Settings of their iTunes or Google Play Account at least 24 hours before the end of the free trial period in order to cancel the chosen subscription.
The subscription can be managed independently through the customer’s iTunes or Google Play Account.
The subscription can be cancelled at any time (even during the days of the free trial) by accessing the Settings of the customer’s iTunes or Google Play Account.
The subscription will renew automatically at the same price unless it is cancelled at least 24 hours before the next renewal date. Any unused portion of the free trial period will be forfeited when a subscription is purchased.
When a subscription is cancelled, access to all features will remain active until the end of the current period. Automatic renewal will be deactivated for the following period, but no refunds are provided for the period already paid.
In the event of an error, Corpore Sano will notify the buyer as soon as possible, allowing the order to be confirmed at the correct amount or cancelled. In any case, Corpore Sano shall not be obliged to supply what was sold at the lower price erroneously indicated.

Art. 7 – Personalised Video Consultation

1. Within the Eathlon app, the user has the option to purchase a personalised Video Consultation with a professional registered in the Register of Corpore Sano S.r.l. or affiliated with Corpore Sano S.r.l.

Corpore Sano S.r.l. has absolute autonomy in managing the collaboration relationship with its affiliated nutritionists.

2. The purpose of the video consultation is to provide further support to the user who follows the Eathlon meal plan, by clarifying, through a dedicated video call, any doubts, questions or requests regarding the meal plan purchased in the Eathlon app.

3. To book their personalised video consultation, the user must:

– Click the dedicated box at the top of the page of their meal plan or in the Support section

– Click, within the dedicated section, the call to action “Book the video consultation”

– Select the preferred available day and time in the calendar

– Enter their details: First name, Last name, email, Tax code, Postal code, City of residence, Address of residence, mobile phone number so that they can be contacted if necessary, first and last name shown on the credit card used for payment, credit card number, and proceed to payment, which will be made through the Stripe platform.

– The cost of the video consultation is Euro 30.00 for 15 minutes

– Once payment has been completed, the user will receive an email with a Google Meet link to connect to on the day of the video consultation

– Once payment has been completed, the user will receive an email with the receipt for the purchase made in accordance with the regulations in force

Art. 8 – Delivery and timing

For the delivery of the Meal Plan, Corpore Sano makes available to its Customers an App in which the meal plan can be viewed, together with the cards for the individual recipes. Within the App, it will be possible to modify physical parameters and food preferences, in order to receive a meal plan that is faithful to and consistent with one’s own needs. EATHLON can be used exclusively through the application available on the App Store and Google Play Store.
Once purchased by the Customer, the Meal Plan will be immediately visible within the App.

Art. 9 – Right of withdrawal

In accordance with the legal provisions in force, the Customer may withdraw from the contract within 15 days, or until the Meal Plan has been delivered.

Art. 10 – Data processing

The Customer’s data is processed in accordance with the legislation on personal data, as specified in the dedicated section containing the notice pursuant to Art. 13 of Regulation (EU) 2016/679 (Privacy Policy).

Art. 12 – Governing law and jurisdiction

These Terms of Sale are governed by and construed in accordance with Italian law, without prejudice to any different prevailing mandatory rule of interpretation of the Customer’s country of habitual residence. Consequently, the interpretation, performance and termination of the Terms of Sale are subject exclusively to Italian law.
Any disputes relating to and/or arising from the Terms of Sale shall be resolved exclusively by the Italian authorities. In particular, where the Customer qualifies as a Consumer, any disputes shall be resolved by the court of the place of the Consumer’s domicile or residence, in accordance with the applicable law.
